Key provisions of the people’s Republic of China’s ecological protection compensation regulation

Over the past 2 decades, the People’s Republic of China (PRC) has developed and implemented policies for ecological protection compensation, embedded in laws such as the Environmental Protection Law, 1989 (revised in 1995, 2002, 2014, and 2020); the Yangtze River Protection Law, 2021; and other regulations concerning water, forests, grasslands, oceans, and fisheries. To effectively regulate these practices, the State Council commissioned the National Development and Reform Commission (NDRC) to develop the comprehensive Ecological Protection Compensation Regulation (EPCR). Since 2019, the
NDRC has led the drafting process, consulting experts, scholars, industry authorities, and 20 departments, including the Ministry of Finance, the Ministry of Natural Resources, the Ministry of Ecology and Environment, the Ministry of Agriculture and Rural Affairs, and the National Forest and Grassland Administration.
The EPCR was released for public comment in November 2020 and submitted to the State Council in March 2021. After further expert consultations by the Legislative Bureau of the Ministry of Justice in December 2021, it was finally approved by the State Council on 23 February 2024. Since 2010, the Asian Development Bank (ADB) has supported the development of ecological compensation laws and regulations in the PRC through technical assistance. In 2019, as the NDRC initiated a new legislative process for the EPCR, ADB funded the Support for National Ecological Compensation Regulation
of the PRC technical assistance project, conducting research on international best practices regarding payments for ecosystem services and relevant foreign legal policies for the EPCR.
